We welcome you and hope you find our websites, mobile applications, web applications, products, marketplace services, communications services, subscription services, and other tools and services helpful and useful. Collectively, these are referred to in this Privacy Policy as the “Services.”
We have adopted this Privacy Policy to help our website visitors, mobile application users, Renters, Hosts, current and prospective customers, clients, employees, contractors, business partners, and other individuals who interact with us (“you” or “your”) understand:
- What information we collect;
- How and why we collect, use, retain, and disclose it;
- How we protect it; and
- What choices and rights may be available to you.
If a capitalized term is not specifically defined in this Privacy Policy, it has the meaning assigned to it in our Terms of Service or other applicable agreement with you.
We seek to improve our Services, and doing so may require us to collect, store, process, use, and disclose information about you and your use of the Services. We are committed to protecting your privacy and maintaining reasonable safeguards for your personal information.
In this Privacy Policy, we use the term “Data” to describe information that relates or may reasonably be linked to you, your household, your device, or your use of the Services. Data is divided into categories described in the “Data We Collect and How We Use It” section below.
The term “Data” does not include information that has been aggregated, anonymized, or de-identified so that it cannot reasonably be linked to an identifiable individual or household (“De-identified Data”). Subject to applicable law, we may use De-identified Data for legitimate business purposes, including analytics, research, service improvement, fraud prevention, operational planning, and reporting.
For the avoidance of doubt, text-messaging originator opt-in data and consent are not treated as De-identified Data for purposes of circumventing the protections described in this Privacy Policy. We will not sell, rent, transfer, disclose, or share SMS opt-in information or consent with third parties for their own marketing or promotional purposes.
This Privacy Policy applies to individuals who interact with us through the Services, by telephone, by text message, by email, in person, or through another authorized communication channel.
Questions about this Privacy Policy or our handling of your Data may be directed to:
Email: support@stackkly.com
Telephone: 1-817-705-9410

By providing your mobile number and affirmatively opting in to a messaging program, you authorize Stackkly to send messages associated with that program to the number provided.
Your consent applies only to the messaging program, purpose, and brand described at the point of opt-in. Consent to one messaging program does not automatically constitute consent to unrelated marketing campaigns.
Consent to receive marketing text messages is not a condition of purchasing goods or services unless expressly permitted by applicable law and clearly disclosed at the point of consent.
Message frequency may vary depending on your transactions, account activity, preferences, and the applicable messaging program.
Message and data rates may apply according to your mobile-service plan.
C. SMS Opt-In Information Is Not Shared for Third-Party Marketing
Your mobile information will not be sold, rented, or shared with third parties for their own promotional or marketing purposes.
All categories of Data described in this Privacy Policy exclude text-messaging originator opt-in data and consent from disclosure to third parties for their own marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be sold, rented, transferred, disclosed, or shared with any third party for such purposes.
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services associated with that campaign.
This restriction applies regardless of whether the disclosure would involve payment. It therefore prohibits not only selling the information, but also transferring or sharing it without payment for another party’s independent marketing or promotional activities.

We may retain your mobile number and opt-out record as reasonably necessary to honor your request, maintain suppression records, demonstrate compliance, resolve disputes, and comply with legal or carrier requirements.

H. Carrier Responsibility and Delivery
Wireless carriers are not liable for delayed or undelivered messages.
Message delivery may depend on carrier availability, network conditions, device settings, telephone-number status, and other circumstances outside Stackkly’s control.
6. HOW WE SHARE INFORMATION
We may disclose Data as described below, subject to the SMS-specific restrictions in Section 5.
Nothing in this section authorizes the sale, rental, transfer, disclosure, or sharing of mobile information, SMS opt-in information, or text-messaging consent with third parties for their own marketing or promotional purposes.

A third party’s independent collection and processing of information is governed by its own privacy policy.
We do not provide mobile information, SMS opt-in information, or SMS consent to such partners for their own marketing or promotional purposes.
A user’s decision to interact with a third-party offer does not authorize Stackkly to transfer the user’s consent to receive Stackkly text messages to that third party.
F. Analytics and Advertising Providers
We may use analytics, measurement, or advertising providers to understand use of the Services and promote Stackkly’s own products or services.
Depending on applicable law and your settings, these providers may receive:
- Cookie identifiers;
- Device identifiers;
- IP addresses;

- Analytics;
- Research;
- Industry reporting;
- Service improvement;
- Business planning;

- Other legitimate business purposes.
We will not attempt to re-identify information that is maintained as legally recognized de-identified information unless permitted by law for testing, security, or compliance purposes.
We will not characterize SMS opt-in information or consent as De-identified Data merely to avoid the SMS restrictions in this Privacy Policy.

We may use widgets or APIs to display or exchange permitted portions of the Services with business partners, such as displaying a public listing on another authorized website.
Only information authorized for the applicable integration will be displayed or transmitted.
8. GLOBAL PRIVACY CONTROL AND “DO NOT TRACK”
Some browsers provide “Do Not Track” signals. There is not currently a universally accepted standard governing how all websites must respond to these signals.
Where required by applicable law, we will process recognized browser-based opt-out preference signals, such as the Global Privacy Control, as a request to opt out of applicable sale, sharing, or targeted advertising for the browser or device from which the signal is sent.
A browser-level signal may not apply to information associated with your account unless you are logged in or otherwise provide information necessary to connect the signal to your account.
You may also contact us directly to exercise applicable privacy rights.

18. SMS PRIVACY COMMITMENT
For clarity, Stackkly’s SMS privacy commitment is summarized below:
Your mobile information will not be sold, rented, or shared with third parties for their promotional or marketing purposes.
Text-messaging originator opt-in data and consent will not be sold, rented, transferred, disclosed, or shared with any third party for that third party’s promotional or marketing purposes.
We will not share your opt-in to a Stackkly SMS campaign with any third party for purposes unrelated to providing the services associated with that campaign.
We may disclose limited Personal Data, including your mobile number and SMS opt-in or consent status, to service providers that help Stackkly transmit, route, deliver, support, secure, or maintain compliance for its messaging services. These providers are not authorized by Stackkly to use that information for their own independent marketing or promotional purposes.
The strongest 10DLC language is intentionally repeated in Sections 4, 5, 6, 10, 13, and 18 so a carrier reviewer can identify the restriction quickly and no broader sharing clause appears to contradict it.
